Mediation is a risk evaluation conversation. In the mediation process, the parties will be asked to discuss all of the risks of going to trial: best case scenarios, worst case scenarios, and costs. Confidentiality will protect the entire mediation process, so many of the “hard” conversations about risk can be fully explored. The goal is always to reach a resolution. But, if a resolution is not reached, hopefully all parties will have a full understanding of the risks and benefits of going to trial.

Donivan has tried civil cases for both the plaintiff and the defense. Donivan has tried family law cases and criminal cases. Some of the trials include: car wrecks, medical negligence, first-party insurance cases, slip-and-fall injuries, business disputes, sexual harassment, eviction, and even a “peeping tom” case.
Beginning in 2020, Donivan transitioned to being a full-time mediator. Since 2020, Donivan has mediated over 700 cases. Donivan’s broad litigation experiences has helped his ability to mediate many types of cases. Although most of Donivan’s mediations deal with car wrecks or family law matters, Donivan routinely mediates other case types such as employment disputes, contract disputes, and estate matters.
